Welcome to Everglades Oysters. By placing an order, accessing our services, or engaging with our products, you agree to the following Terms of Service. Please read them carefully.

1. Overview

Everglades Oysters is a Florida-based aquaculture operation and wholesale distributor providing harvest-to-order oysters to restaurants, distributors, and approved buyers. We operate a direct-from-farm model to ensure premium quality and freshness.

2. Eligibility

By purchasing from Everglades Oysters, you confirm that:

You are at least 18 years of age
You are authorized to make purchases on behalf of your business (if applicable)
You will comply with all local, state, and federal food safety regulations

Wholesale accounts may require approval prior to fulfillment.

3. Orders & Availability

All oysters are harvest-to-order and subject to environmental conditions, tides, and farm operations.

Orders must be submitted by Friday for harvest the following week
Availability is not guaranteed until confirmed by our team
We reserve the right to limit or cancel orders based on supply conditions

4. Pricing & Payment

All pricing is subject to change without notice
Payment terms will be agreed upon during onboarding (e.g., Net terms or prepayment)
Late payments may result in suspension of service

Accepted payment methods include ACH, wire transfer, and approved business payment methods.

5. Delivery & Fulfillment

We coordinate delivery or pickup based on your location and agreement.

Delivery windows are estimates and may vary
Risk transfers to the buyer upon delivery or pickup
Customers must ensure proper refrigeration upon receipt

Everglades Oysters is not responsible for product quality after delivery if handling guidelines are not followed.

6. Product Handling & Food Safety

Our oysters are a raw, perishable product.

By purchasing, you acknowledge:

Raw shellfish may carry inherent health risks
Proper storage at or below 41°F (5°C) is required
Product should be consumed within recommended timeframes

You assume all responsibility for safe handling once the product is received.

7. Returns & Claims

Due to the perishable nature of our product:

All sales are final
Any issues must be reported within 24 hours of delivery
Claims must include photos and detailed descriptions

We will review claims and may offer replacement or credit at our discretion.

8. Force Majeure

We are not liable for delays or failure to fulfill orders due to events beyond our control, including but not limited to:

Weather conditions
Natural disasters
Regulatory closures
Supply chain disruptions

9. Intellectual Property

All content, branding, product names, and materials associated with Everglades Oysters are the property of Everglades Oysters and may not be used without written permission.

10. Limitation of Liability

To the fullest extent permitted by law:

Everglades Oysters shall not be liable for any indirect, incidental, or consequential damages arising from the use or consumption of our products.

Our total liability shall not exceed the value of the product purchased.

11. Indemnification

You agree to indemnify and hold harmless Everglades Oysters from any claims, damages, or liabilities arising from improper handling, resale, or service of our products.
